Legal advice in a complex court case – the Client reached a favourable court settlement

We are pleased to announce that in a case handled by our Law Firm, our Client obtained a satisfactory amount of several million zlotys as part of a court settlement.
Represented by our Law Firm, the Client sought payment in court for her capital share in connection with her withdrawal from a general partnership (a well-known manufacturer of women’s underwear) and remuneration for the copyright to the underwear designs created by the client, which the company had been using for 10 years to manufacture and sell goods.
Thanks to effective and accurate arguments, the Client obtained a favourable value of her capital share in the opinion of a court expert. Preparing these arguments required in-depth analysis and proficiency in the application of company law as well as accounting principles, financial auditing and business valuation.
A significant subject of the dispute was a claim for remuneration for the company’s non-contractual use of 6,000 lingerie designs created by the client over a period of 10 years, which the company used to manufacture and sell goods under its own trademark. The dispute boiled down to the court deciding whether the Client was entitled to copyright in the lingerie designs she had created as a partner in the company. In this regard, the effective argumentation presented on behalf of the Client regarding her economic copyrights to the designs required the skilful use of provisions of company law, copyright law and industrial property law.
Negotiations conducted before the court led to a settlement favourable to the client, which ended the eight-year court proceedings. As a result of the settlement, in addition to her share in the company’s capital, the client obtained satisfactory remuneration for the economic copyrights to the designs.
