  1. INTRODUCTION 

    1. This Privacy Policy applies to the personal data of the Users (hereinafter collectively referred to as: “Users” and individually “User“, and when the Users have a business relationship with FORTON Legal Łatała i Wspólnicy sp. k. “Clients“) using the website operating at https://forton.legal/ (hereinafter: “the Site“) and its sub-sites and:
    2. participating in the recruitment process conducted by FORTON Legal Łatała i Wspólnicy sp. k. via a contact form placed on the Site;
    3. contacting FORTON Legal Latała i Wspólnicy sp. k. for any other purpose personally, by phone, post or e-mail;
    4. being the subscribers of the Newsletter published by FORTON Legal Łatała i Wspólnicy sp. k. Newsletter;
    5. visiting profiles maintained by FORTON Legal Łatała i Wspólnicy sp.k. in social media.
  2. PERSONAL DATA CONTROLLER 

    1. The controller of the Users’ personal data is FORTON Legal Łatała i Wspólnicy sp. k. with its registered office in Krakow, ul. Szlak 67, 31-153 Kraków, registered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków – Śródmieście in Kraków, XI Commercial Division of the National Court Register, under KRS number 0000048231, NIP 6772068828 (hereinafter: “Controller“).

  3. THE PURPOSE, SCOPE AND LEGAL BASIS OF THE PROCESSING OF PERSONAL DATA

    1. The Controller may process Users’ personal data in accordance with the principles set out in the Privacy Policy. Personal data shall be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016, p. 1–88 as amended, hereinafter: “GDPR“).
    2. The Controller may share personal data with other entities, in particular:
      1. employees and collaborators of the Controller;
      2. entities cooperating with the Controller in the field of marketing, IT, accounting and recruitment services;
      3. other entities authorised to access personal data under applicable legislation.
    3. The processing of the User’s personal data is carried out for the following purpose and to the extent indicated below:
      1. responding to messages addressed to the Controller sent to its contact details – based on the Controller’s legitimate interest – Article 6(1)(f) GDPR, the processing concerns the following data: name, surname, telephone number, e-mail address, other data provided by the User;
      2. to carry out the recruitment of candidates for employment or cooperation – based on the User’s consent or in connection with taking action at the request of the data subject prior to the conclusion of a contract by the latter – Article 6(1)(a) or (b) GDPR, the processing concerns the following data: name, surname, address, e-mail address, telephone number, other data provided by persons participating in the recruitment;
      3. the pursuing and defence of claims, before and outside the courts and administrative authorities – based on the legitimate interest of the Controller – Article 6(1)(f) GDPR, the processing concerns the following data: name, surname, address, e-mail, other data necessary to prove the existence of a claim or the defence of rights;
      4. to carry out marketing and promotional activities by the Controller – based on the Controller’s legitimate interest if the User is the Controller’s Customer – Article 6(1)(f) GDPR or based on the User’s consent if the User is not the Controller’s Customer – Article 6(1)(a) GDPR, the processing concerns the following data: name, surname, address, e-mail, telephone number;
      5. sending the Newsletter – based on the legitimate interest of the Controller – Article 6(1)(f) GDPR, processing concerns the following data: name, surname, company, e-mail;
      6. to carry out statistical activities, to analyse the use of the Site and to ensure the security and enhance the functionality of the use of the Site – based on the Controller’s legitimate interest – Article 6(1)(f) GDPR, the processing concerns the following data: IP address, type and version of device, type of browser used, cookies selected, how the Site is used;
      7. archiving and back-up – based on the legitimate interest of the Controller – Article 6(1)(f) GDPR, the processing concerns any data obtained from the User in connection with the interaction with the Controller;
      8. to comply with obligations imposed by law – based on the legitimate interest of the Controller – Article 6(1)(f) GDPR, the processing concerns any data obtained from the User in connection with the interaction with the Controller;
    4. The Controller processes the Users’ personal data only to the extent necessary in connection with the User’s interactions on the Site and the use of the tools made available to the User (contact form, Newsletter). The Controller uses technical solutions which prevent the acquisition and modification of the Users’ personal data by unauthorised persons and exercises supervision over the process of personal data processing in order to avoid loss, distortion or destruction of the processed information. Users’ personal data is not transferred to countries outside the European Economic Area.
    5. The Site contains links directing the User to third-party websites that have different rules than those described in this Privacy Policy regarding the processing of personal data. You are advised to familiarise yourself with the rules applicable to the processing of personal data published by the controllers of these websites.
  4. PERIOD OF PERSONAL DATA PROCESSING 

    1. The User’s personal data shall be processed:
      1. to the extent that the processing relates to responding to messages addressed to the Controller – for as long as is necessary to respond to the User’s enquiries, make business offers to the User and conduct correspondence;
      2. to the extent that the processing relates to the recruitment of candidates for employment or cooperation – until the end of the recruitment in question, and in the event that the User has given consent to the processing of his/her personal data for future recruitment until the withdrawal of the consent given;
      3. to the extent that the processing relates to the pursuing and defence of claims, before and outside the courts and administrative authorities – for a period not exceeding the period of limitation of claims;
      4. to the extent to which processing relates to the performance of marketing and promotional activities by the Controller – during the period of provision of services by the Controller to the Customer when processing is based on the Controller’s legitimate interest or until the withdrawal of consent or objection by the User;
      5. to the extent to which processing relates to the sending of the Newsletter – until such time as subscription is cancelled, the User raises an objection or the Controller ceases to issue the Newsletter;
      6. to the extent that the processing relates to the performance of statistical activities, analysis of the use of the Site and ensuring the security and enhancing the functionality of the use of the Site – for the period in which the data are necessary for this purpose;
      7. to the extent that the processing relates to archiving and backup – for the period determined in accordance with the Controller’s backup and archiving policy;
      8. to the extent that the processing relates to the performance of obligations imposed by law – for the period necessary to demonstrate that the Controller has not failed to comply with the obligations in question;
  5. RIGHTS RELATING TO THE PROCESSING OF PERSONAL DATA

    1. You have the following rights in relation to the Controller’s processing of your personal data:
      1. The right to be informed about the data processed by the Controller, the right of access to the data and to receive a copy of the data (Article 15 of the GDPR);
      2. The rights to withdraw consent to the processing of personal data where the legal basis for the processing is the User’s consent (Article 7 GDPR);
      3. The right to rectification of personal data (Article 16 GDPR);
      4. The right to data portability (Article 20 GDPR);
      5. Rights to erasure and to restriction of processing (Articles 17 and 18 GDPR);
      6. Rights to object to the processing of personal data (Article 21 GDPR);
      7. The right to lodge a complaint with a supervisory authority, i.e. the President of the Personal Data Protection (Article 77 GDPR).
  6. NEWSLETTER 

    1. Each User has the possibility to subscribe to the Controller’s Newsletter by providing the following data:
      • First and last name;
      • Company;
      • E-mail address.
    2. Newsletter subscription requires consent to send commercial information by the Controller by means of electronic communication in accordance with the Act of 18 July 2002 on Electronic Service Provision (t.j. Dz. U. of 2020 r. poz. 344). Lack of this consent will prevent the Newsletter from being sent to the User. The consent in question may be revoked at any time, which will entail discontinuation of sending the Newsletter.     3. The Controller pays special attention to the accuracy and correctness of the sent content, while stipulating that it should not be treated as legal advice or official interpretation of the law. The Controller shall not be liable for any damages arising from or in connection with the content posted in the Newsletter.
    4. The User’s personal data within the scope of the possibility to subscribe to the Newsletter are processed on the basis of the legitimate interest pursued by the Controller in the form of marketing and information activities.
  7. COOKIES

    1. The Controller informs that the Site uses cookies.
    2. Cookies are small text files that are created automatically by your browser when you visit websites. The information contained in a cookie can only be read by the website from which the cookie originated. Thus, the website cannot access other files on your computer. The  Site uses cookies in order to maintain the User’s session, to adapt the Site to the User’s needs, in particular the devices and software used, to create the Site viewing statistics, to monitor the operation of the Website and to improve its functioning.
    3. The following types of cookies are used in the operation of the Site:
      1. essential cookies, i.e. cookies that ensure the proper functioning of the Site and its basic functions;

This information allows us to measure the effectiveness of marketing or information activities.Necessary cookies are used by default, i.e. they are stored on the User’s device when he/she accesses the Site (pursuant to Article 173 (3) of the Act of 16 July 2004 on Telecommunications). Other cookies are used only if the User gives his/her consent.
